Three counts each
Erie Environmental Services Inc. and its president Daniel Andrew Tiessen have been fined a total of $126,000 —plus victim fine surcharges—after being convicted on three counts each under the Environmental Protection Act (EPA).
Erie Environmental, a waste-hauling company in Leamington, Ont., is authorized, through a provisional certificate of approval, to operate a waste management system.
The court heard that, in response to a complaint in October 2001, Ministry of the Environment (MOE) staff confirmed that Erie Environmental Services Inc. was operating an unapproved waste disposal transfer station behind a commercial building in Chatham.
An MOE investigation also confirmed that Erie Environmental’s certificate of approval stipulates that the company is only authorized to deliver waste to an approved waste disposal facility.
The ministry issued a Provincial Officer Order that required Erie Environmental Services Inc. to immediately remove the waste and deliver it to a certified disposal site.
Tiessen and his company did not carry out this requirement. Justice of the Peace Ron Trachy convicted the defendants on July 21, 2004 and sentenced them on August 5, 2004 in the Ontario Court of Justice in Chatham-Kent.
